CRIMINAL DEFENSE ATTORNEYS SHOULD BE MORE WILLING TO SHARE AND TO HELP ONE ANOTHER.
There are some compelling reasons why criminal defense attorneys should be more willing to share. Criminal defense attorneys, like many other lawyers in other practice areas, are reticent to share their ideas, motions, briefs, and trial techniques with other attorneys because they are fearful that other lawyers will use the materials to create a financial advantage. That may be true in other practice areas, but this concern simply is not viable within the criminal defense practice area. There are a couple of reasons why criminal defense attorneys should be more willing to share ideas, motions, brief, and trial techniques with other criminal defense attorneys.
STOP WORRYING ABOUT SHARING PRACTICE INFORMATION COSTING YOU MONEY
If you have been a criminal defense attorney for more than 5 years, you have probably noticed that financial achievement in the criminal defense practice area has very little correlation to the actual ability of the lawyer. Generally speakings, lawyers that are really good at marketing are not very good lawyers. Do not ever be concerned about those lawyers stealing your ideas.
THERE IS VERY LITTLE RELATIONSHIP BETWEEN COURTROOM SUCCESS AND FINANCIAL SUCCESS BY CRIMINAL DEFENSE ATTORNEYS.
The market for criminal defense attorneys is very inefficient. It is very difficult for criminal defendants to obtain accurate information regarding a lawyer’s ability and willingness to challenge criminal charges.
FOCUS ON GROWING THE PIE! MAKE OTHERS BETTER, AND IT WILL HELP YOU.
One of my friends tells me pretty regularly that we can make the pie bigger by sharing information. She is right. The criminal defense practice area – at least among criminal defense attorneys – need not be a zero-sum game. We can grow the pie, increase the overall quality of representation that criminal defendants receive by sharing information and ideas amongst one another.
SHARING INFORMATION AND IDEAS AMONGST OTHER CRIMINAL DEFENSE ATTORNEYS HELPS GAIN ACCEPTANCE OF INNOVATIVE IDEAS
When one attorneys is arguing a new or innovative position, it is very difficult for a judge to accept that position when the law appears contrary to even a well-reasoned position. However, when a wider range of criminal defense attorneys moves forward with a similar argument, judges will find it increasingly difficult to dismiss the position.
