An interesting case involving an out-of-state personal injury law firm soliciting cases involving a local nursing home is being considered by the Georgia Supreme Court. The summary of the case, which is prepared by the Georgia Supreme Court, is below:


The case is important both for the precedent that it will set with regard to commercial speech limitations on lawyers and law firm, and it also can provide some practical guidance for personal injury lawyers seeking to target certain practice areas and client of those businesses.
The personal injury law firm in this case could have very easily avoided this problem, and the use of the nursing home's intellectual property brought very little additional value to the firm.
