For other motorists on the roadways, encountering a driver that is tired may be as dangerous or deadly as encountering a persona that is driving while under the influence of alcohol or drugs. Often times, drivers that are extremely fatigued are even more dangerous to others that drivers that are intoxicated by alcohol or drugs. Similar to drivers that are under the influence of alcohol or drugs, a driver that is fatigued does not perceive dangers on the road and does not react logically (or quickly) to changes in roadway conditions. In fact, many fatigued (overly tired) drivers do not react at all to other traffic prior to an accident. Many fatigued drivers are similar to the most intoxicated people that we see on the road.
SHOULD WE TREAT FATIGUED DRIVERS AS HARSHLY AS WE TREAT DUI DRIVERS THAT CAUSE ACCIDENTS?
There are a lot of reasons why would treat fatigued drivers that cause accidents as harshly as we treat similarly situated DUI drivers. The decision to drive while fatigued is as selfish as the decision to drive while intoxicated. In some cases, it is arguably more aggravated. Because the driver is cognizant of their condition and knowingly proceeds, they are literally acting with conscious disregard for the safety of others.
