Our client was found by a member of the Atlanta Police Department passed out behind the wheel of his automobile in the parking lot of bar. A Georgia State Patrol Nighthawks DUI Task Force member was requested to perform a DUI investigation upon our client. The officer noticed a strong odor of alcohol as well as watery and bloodshot eyes, so the officer requested that our client submit to field sobriety tests, which he consented to. He demonstrated 6 of 6 clues on the HGN test, as well as 15 of 16 clues on the one-leg-stand test. Our client refused to submit to a breath test and was subsequently arrested and taken to Atlanta Pre-Trial where he consented to the state administered breath test producing results of .103 and .101. Atlanta DUI lawyer Ben Sessions successfully obtained a full dismissal of the DUI prior to a motion hearing.
