Passenger in car accident killed on January 31, 2018 in Macon, GA

It is not uncommon for people to be seriously injured or killed in accidents that are caused by driver’s of the car that they are traveling in. Intrafamily tort immunity provisions in insurance contracts may bar the ability of some people to obtain a full recovery in car accidents caused by their driver. The passenger in a car that wrecked in Macon died from injuries sustained in the accident.

About 11:20 a.m. Tuesday, Vicki King, 62, and her passenger, Michael King, 65, of Lizella, were traveling along the 1000 block of Tucker Road when King’s vehicle left the roadway and struck a tree, according to a release from the Bibb County Sheriff’s Office.

Both people were transported to the Medical Center, Navicent Health, for treatment. Michael King later was pronounced dead by doctors. The accident is currently under investigation.

Given that the occupants have the same last name, it appears that they are probably related and, therefore, it must be determined whether the insurance policy has an exclusion for intrafamily claims. Any uninsured motorist policies must also be investigated.
