Why is it important for your lawyer to understand technical evidentiary issues related to your injury case? It’s really important for your lawyer to understand both the legal aspects of the case and the actual factual scientific issues that are involved in almost every single one of our cases. Whether or not it is an accident reconstruction issue, whether or not it is a surgical medical issue, whatever it may be, your lawyer needs to have some working knowledge of those issues in your case, beyond just the legal issues that you’re going to inevitably have to deal with because if they don’t, what you’ll quickly realize is that they, it takes them a much longer time to get up to speed and they’re never going to reach a level of preparation that someone would, let’s say for example, if they had prior experience, had dealt with those issues and really understood them in depth going into the case now, no one obviously who’s a lawyer can understand all of the issues as well as an expert could, but just by virtue of having some prior experience having dealt with the things before, having some working knowledge of the issues, one, they’re going to pick up on things much quicker.
They’re also going to understand which experts are necessary to actually prepare the case for a trial. I am, and they’re going to understand how it is to prepare for the other side’s witnesses, how to attack their credibility, how to attack their opinions. Because if you add, if you have some good working knowledge of it, then you’re going to know what the issues are, things that you can pick up on, things that are potential strengths and weaknesses that you can use to your benefit.
