These are links to a transcript for an appeal from a trial court’s ruling in our favor on a motion issue.
The is whether a urine test is covered by the Self-Incrimination Clause of the Georgia Constitution. The trial court found that the urine test requested in this case would have required the Defendant to perform the act of relaxing the sphincter muscles of his bladder, and, therefore, properly held that the requested act was protected by the Georgia Constitution’s Self-Incrimination Clause.
