Gray Highway: A Half-Mile Between Crosswalks, and What That Means for a Claim

By Ben Sessions on October 6th, 2026 in Personal Injury

When a pedestrian is struck on Gray Highway, the insurance company’s first sentence is almost always some version of: he wasn’t in a crosswalk.

The more useful question is where the nearest crosswalk was.

What GDOT measured

Gray Highway is one of the pedestrian safety focus corridors identified in the Georgia Department of Transportation’s 2018–2022 Pedestrian Safety Action Plan. Analyzing 2011–2015 crash data, GDOT studied the segment from Clinton Street to Woodlawn Drive — about 1.5 miles — and recorded:

  • posted speeds of 35 to 55 mph;
  • traffic volumes between 23,700 and 47,600 vehicles per day;
  • five serious injuries and four fatalities in that study window; and
  • marked crossings spaced approximately 2,640 feet apart.

That last figure is the one worth sitting with. Twenty-six hundred and forty feet is half a mile. On a road carrying up to 47,600 vehicles a day, at speeds up to 55 mph, through a part of Macon where a significant number of residents walk because they do not have another option.

Bibb County as a whole is one of twelve statewide pedestrian safety focus counties in that plan, with 377 pedestrian crashes, 299 injuries, and 27 deaths recorded over the same five years.

The county has acknowledged the problem and is spending money on it

In September 2024, Macon-Bibb County received a $5.6 million federal Safe Streets and Roads for All grant aimed at exactly this corridor. The funded work includes a mile of sidewalk from Shurling Drive to Woodlawn Drive — replacing dirt footpaths worn into the shoulder by people walking where there was no sidewalk — three miles of multi-use path on Old Clinton Road and Boulevard, added street lighting, and two push-activated crosswalks. GDOT has separately installed pedestrian refuge medianettes on Gray Highway.

The county applied for this funding twice. A $4 million application was declined in January 2024; a revised application went back in May 2024 and was awarded in September.

Macon-Bibb also adopted a Vision Zero Action Plan in late 2020, targeting zero traffic deaths and serious injuries by 2040. An analysis supporting that work reviewed 301 pedestrian-involved crashes from 2019 through 2022 and found 50 deaths and 244 injuries, and identified five pedestrian hotspots: Mercer University Drive near Columbus and Anthony Roads; Ell Street and U.S. 41; Vineville Avenue between Lamar and Ward Streets; Plum Street Lane and Second Street; and Riverside Drive at Spring Street.

Why any of this matters to your case

It matters for two distinct reasons, and they work differently.

First, on comparative fault. Georgia applies modified comparative negligence: an injured person who is partly at fault still recovers, reduced by their share, so long as that share stays below 50%. Crossing outside a crosswalk is evidence a jury may weigh. It is not a rule that ends a case.

When the jury learns that the nearest legal crossing was a quarter mile in one direction and a quarter mile in the other, on a five-lane road, the question shifts. It stops being “why didn’t he walk to the crosswalk” and becomes “what would any reasonable person in that position have done.” Meanwhile the driver’s conduct — speed, attention, headlights, reaction — stays squarely in issue, where it belongs.

Second, on foreseeability. GDOT’s own documents identify this corridor, by name, as a place where pedestrians are seriously injured and killed, and describe the conditions that produce it. The county’s grant application says the same thing. That body of public record speaks to whether the risk at this location was known, which is a different question from whether a particular driver was careless.

Claims that reach GDOT or Macon-Bibb County face substantial hurdles — sovereign immunity, discretionary-function defenses, and unforgiving notice requirements. A claim against Macon-Bibb County should be treated as requiring written notice within six months. A claim against a State entity such as GDOT runs on the Georgia Tort Claims Act’s twelve-month notice, which courts enforce strictly and which requires service on both the Risk Management Division of the Department of Administrative Services and the agency itself. These are not claims to identify late.

What the statewide data says about crashes like these

Georgia’s 2023 pedestrian fatality data describes the Gray Highway profile almost exactly: 72% of pedestrian deaths occurred on roads posted at 45 mph or higher and 83% in dark conditions. And over the past decade, more than three-quarters of Georgia’s fatal pedestrian crashes have happened away from intersections.

This is not bad luck distributed randomly. It is a predictable output of a particular kind of road.

What to do after a Gray Highway pedestrian crash

  • Document the distance to the nearest marked crossing in both directions. Photograph it. This is frequently the single most persuasive fact in the file.
  • Return at the same hour, in the same light. A daytime photograph of a nighttime crash misrepresents the scene.
  • Photograph the lighting, the shoulder, the median, and any worn footpath showing where people actually walk.
  • Find video fast. The businesses along this corridor run cameras that overwrite in days.
  • Keep the clothing and shoes, unwashed. Paint transfer and reflectivity become evidence.
  • Check for uninsured motorist coverage. Hit-and-run is a persistent feature of Bibb County pedestrian crashes, and UM coverage on your own or a resident relative’s policy can respond even though you were on foot.

Where to go from here

Pedestrian cases on this corridor are serious, they are aggressively defended, and the evidence that answers the defense is gone within a week or two.
