Bibb County DUI Refusal Case Nolle Prossed for Insufficient Evidence
A sheriff’s deputy found our client asleep in a car parked off the roadway. No traffic violation was observed, and our client declined field sobriety tests and a state blood test. He was charged with DUI in Bibb County State Court.
We filed a supplemental motion to suppress challenging reasonable suspicion, probable cause and the use of the refusals at trial. Shortly afterward the State dismissed the case, citing insufficient evidence to prove an essential element. Because no suspension paperwork was filed, our client’s license was never suspended.
Every case turns on its own facts. Past results do not guarantee a similar outcome in any future matter.
