Macon DUI Dismissed: State Could Not Justify the Traffic Stop
Our client was charged in Bibb County State Court with DUI per se, DUI less safe and failure to maintain lane after a Georgia State Patrol stop. A blood test reported a result over the legal limit, and the State’s plea offer was a DUI conviction with jail time.
We filed motions challenging the stop, the implied consent process and the reliability of the blood test. Faced with those motions, the State moved to nolle pros every charge, conceding it could not show probable cause for the initial stop.
Every case turns on its own facts. Past results do not guarantee a similar outcome in any future matter.
