Our client was followed by an off-duty deputy who allegedly saw him swerve and weave numerous times on I-85. The off-duty deputy called 911 and a Gwinnett County Police Department officer located our client’s vehicle. Our client smelled of alcohol, so the officer requested that he submit to field sobriety tests, which our client consented to. He showed 6 of 6 clues on the HGN test and numerous clues on the walk-and-turn and one-leg stand tests. Our client allegedly told the officer, “[o]bviously I’m not in the condition to drive after seeing that.” Our client submitted to a breath test that produced results of .098 and .106. Prior to trial and after litigating numerous motions, Ben Sessions successfully obtained a dismissal of the DUI in exchange for a plea to reckless driving. This result allowed our client to maintain his CDL.
