After a DUI Arrest in Middle Georgia: What to Do in the First 30 Days

If you were arrested for DUI last night in Macon, Warner Robins, or anywhere in middle Georgia, there is one thing you need to understand before you do anything else: the clock is already running on your driver’s license.
Most people focus on the criminal charge — the court date, the fine, the record. That case matters, and we will fight it. But there is a second, separate case that almost nobody warns you about, and it moves faster than the criminal one. If you don’t act within 30 days of your arrest, the State can suspend your license automatically — before you ever see the inside of a courtroom.
Here is exactly what happens in those first 30 days, the decision you have to make, and how to protect yourself.
The two cases you’re actually facing
A DUI arrest in Georgia sets off two completely separate proceedings:
- The criminal case — handled in court (for example, the State Court of Bibb County in Macon or the State Court of Houston County in Warner Robins). This is where the DUI charge itself is decided. It can take months.
- The administrative license case (ALS) — handled by the Georgia Department of Driver Services (DDS), not the court. This is a fight purely over your driving privileges, and it has a hard 30-day deadline.
The mistake we see over and over is people waiting for their court date to “deal with everything at once.” By then, the 30-day window on the license case has already closed — and the suspension has already started.
The 30-day deadline, in plain terms
When you were arrested and the officer took (or requested) a breath, blood, or urine test, you were handed a form called a DDS Form 1205. That form is doing two things: it’s your temporary 30-day driving permit, and it’s the notice that your license will be suspended for up to a year unless you act.
You have 30 days from the date of arrest to make a choice. If you do nothing, your license is automatically suspended on roughly day 46 — for a first offense, that’s a one-year suspension.
Your two options inside that window
Inside the 30 days, you choose one of two paths:
Option 1 — Request an ALS hearing. You (or your lawyer) file a request with DDS and pay a $150 fee. This does two valuable things: it keeps you legally driving while the hearing is pending, and it gives your attorney a rare early shot at the officer — the ALS hearing is often the first and best chance to question the arresting officer under oath and lock in testimony we can use in the criminal case later. This is usually the stronger path when there’s any argument to be made about the stop, the testing, or the arrest.
Option 2 — Install an ignition interlock device and get a limited permit. If it’s a first offense within five years, you can instead have an ignition interlock device installed on your vehicle and receive a limited driving permit that lets you get to work, school, medical appointments, court, and probation. Choosing this option means you waive the ALS hearing — so it’s a trade-off, not a free pass, and it should be a deliberate strategic decision, not a default.
Which option is right depends on the specific facts of your stop and whether you took the test or refused it — which brings up the most important distinction of all.
Refusal vs. a failed test — this changes everything
- If you took the test and blew 0.08 or higher (0.02 if you’re under 21), a first-offense suspension generally allows a limited permit after you enroll in DUI school.
- If you refused the test, a first offense can mean a one-year “hard” suspension with no limited permit at all — no work driving, nothing — unless your attorney successfully challenges the suspension at the ALS hearing.
That’s why refusal cases are exactly the ones where letting the 30 days slip by is most damaging, and where an experienced DUI lawyer earns their keep.
What you should do this week
- Find your DDS Form 1205 and note your arrest date. Count 30 days forward. That is your deadline. Put it on your calendar today.
- Don’t wait for your court date. The license case and the court case are on different clocks.
- Write down everything you remember about the stop while it’s fresh — where you were pulled over, what the officer said, what tests you were asked to do.
- Talk to a DUI lawyer before you choose an option. The hearing-vs-interlock decision, especially in a refusal case, can shape the entire outcome. This is not a form to guess your way through.
