Forsyth DUI Lawyer: Board Certified in DUI Defense

Ben Sessions is a Board Certified DUI Defense Specialist through the National College for DUI Defense, the certifying organization accredited by the American Bar Association, and one of four lawyers in Georgia with that certification. He has taught more than 30 continuing legal education courses on DUI defense and has handled DUI appeals before the Georgia Court of Appeals and the Supreme Court of Georgia, including cases that changed how Georgia courts treat DUI evidence.

Our Macon office is about 25 miles down I-75 from Forsyth, and we handle DUI cases in the Monroe County courts and the surrounding counties of middle Georgia.

This page covers the City of Forsyth and Monroe County in middle Georgia. If you were arrested in Forsyth County north of Atlanta, see our Forsyth County DUI page.

After a DUI Arrest in Monroe County

Interstate 75 runs the length of Monroe County, and many DUI arrests here come from traffic stops on I-75, I-475, U.S. 41, U.S. 23, and Georgia 42, as well as the streets around downtown Forsyth. Whatever the location, the first steps are the same:

  • Write down what you remember. Where you were stopped, what the officer said was the reason, which field sobriety tests you were asked to do, and whether you were read the implied consent notice.
  • Keep your paperwork. Your citation, bond paperwork, and any form the officer handed you (often a DS-1205 notice of suspension) tell us which court has your case and what deadlines apply.
  • Do not discuss the case with anyone other than your lawyer, including on social media.
  • Call a DUI lawyer before the 30-day deadline described below.

The 30-Day Deadline to Save Your License

If you refused the state-administered test or tested at or above the legal limit, your license is subject to an administrative suspension that is separate from the criminal case. Under Georgia law you generally have 30 days from the date of arrest to act: either request an Administrative License Suspension (ALS) hearing, or, in many cases, install an ignition interlock device and drive on a limited permit instead. Choosing between those options is a strategic decision. An ALS hearing can give us sworn testimony from the arresting officer early in the case, while the interlock option can keep you driving. Missing the deadline means losing both choices.

Where Your Case Will Be Heard

Monroe County is in the Towaliga Judicial Circuit. Unlike Bibb or Houston County, Monroe County does not have a State Court, so where your DUI case goes depends on where you were arrested and how the case is charged.

Forsyth Municipal Court

DUI and traffic citations written inside the Forsyth city limits, usually by the Forsyth Police Department, including stops on the stretch of I-75 that runs through the city, typically start in Forsyth Municipal Court.

Monroe County Probate Court

Misdemeanor DUI and traffic cases from outside the city limits, including arrests by the Monroe County Sheriff’s Office and the Georgia State Patrol, are generally handled in the Monroe County Probate Court at the courthouse in Forsyth. Probate court does not hold jury trials. If you demand a jury trial, the case is transferred to Superior Court, and whether to make that demand is one of the first decisions we make together.

Monroe County Superior Court

Felony DUI charges, such as a fourth DUI within ten years or a DUI involving serious injury or death, are prosecuted in Monroe County Superior Court by the District Attorney for the Towaliga Judicial Circuit. Misdemeanor cases can also end up there after a jury trial demand.

What We Look At in Every Monroe County DUI Case

  • The reason for the stop. An officer needs a lawful basis to pull you over. Interstate stops often begin with an alleged lane violation or speeding, and the video does not always match the report.
  • Field sobriety tests. Tests like the horizontal gaze nystagmus (HGN) test have to be administered and scored in a standardized way. Traffic noise, flashing lights, and a sloped interstate shoulder at night often make that difficult.
  • Implied consent. Whether the officer read the correct implied consent notice at the right time, and whether your consent was voluntary.
  • Breath and blood testing. Intoxilyzer maintenance and operator certification records, and for blood draws, the chain of custody and lab procedures. We also look closely at hospital blood tests after a crash.
  • Video. Dash camera and body camera footage frequently tells a different story than the police report.

Georgia DUI Penalties

Penalties depend on your record and the facts of the arrest. For a first DUI conviction in Georgia, the sentence can include:

  • At least 24 hours and up to 12 months in jail, much of which is usually probated
  • A fine of $300 to $1,000, plus court costs and surcharges
  • At least 40 hours of community service
  • The DUI Alcohol or Drug Use Risk Reduction Program and a clinical evaluation
  • Probation and a driver’s license suspension

Penalties increase for a second or third DUI within ten years, for a high breath or blood result, and when a child under 14 was in the vehicle. Drivers under 21 face a 0.02 limit, and commercial drivers face a 0.04 limit and possible loss of their CDL, a real concern for the many truck drivers who travel I-75 through Monroe County. Forsyth DUI Questions

I don’t live in Georgia. What happens to my case?

Many people arrested on I-75 in Monroe County are passing through from other states. A Georgia DUI can still affect your home-state license, and missing a Georgia court date can lead to a bench warrant. In many cases we can appear on your behalf and handle much of the case without repeated trips back to Forsyth.

Will I lose my license?

Not necessarily. If you act within 30 days of the arrest, you may be able to challenge the administrative suspension at an ALS hearing or keep driving with an ignition interlock permit. What happens to your license in the criminal case depends on how that case is resolved.

What is the legal limit in Georgia?

The limit is 0.08 for most adult drivers, 0.04 for commercial drivers, and 0.02 for drivers under 21. You can also be charged with DUI “less safe” at any level if the State claims alcohol or drugs impaired your driving.

Can I refuse the breath test?

You can refuse, but a refusal can lead to an administrative license suspension. Since the Supreme Court of Georgia’s 2019 decision in Elliott v. State, prosecutors cannot use your refusal to take a breath test as evidence against you at trial. Refusing a blood test is treated differently, so talk to a lawyer about the facts of your case.

My case is in probate court. Do I need a lawyer?

Yes. A DUI conviction in probate court carries the same penalties and the same permanent record as one in any other court. Georgia law does not allow a DUI conviction to be expunged, so the decisions you make early in the case matter.

Nearby Courts We Handle

In addition to Monroe County, we defend DUI cases throughout middle Georgia, including Macon and Bibb County, Warner Robins, Perry, and Houston County, Milledgeville and Baldwin County, and Dublin and Laurens County. If you were hurt in a crash in the Forsyth area, see our Forsyth personal injury page.
