Our client was stopped on State Bridge Road in Johns Creek, GA, for failing to maintain her lane of travel. The video showed that our client slightly crossed over the right fog line with her passenger-side tires. Following this violation, our client was stopped. Our client denied consuming alcohol, but the officer said that he smelled alcohol and that our client’s eyes were bloodshot and watery.
Then, the officer asked our client to exit her vehicle. At first, our client refused to exit her vehicle. After the officer threatened to forcibly remove her from the car, our client exited, but she refused to submit to any field sobriety tests and she also refused the state-administered breath test. Our client was charged with DUI, possession of an open container, and failure to maintain her lane.

This case was transferred to the Fulton County State Court for a jury trial. Prior to trial, we obtained a dismissal of our client DUI and open container charges. Our client entered a guilty plea to failure to maintain lane.
