Our client was charged with failure to obey a traffic control device and DUI Less Safe (Alcohol). This case originally began in the Smyrna Municipal Court. We transferred the case to the Cobb County State Court when we were unable to negotiate a non-DUI disposition. You can transfer any DUI case originating in a Probate or Municipal Court in Georgia to a State or Superior Court with the filing of a demand for a jury trial. Typically, with the filing of a demand for a jury trial, the DUI case is moved to a State Court in which there is a different prosecutor handling the case. So, you have an opportunity for a fresh start at negotiations. When we moved this case to the State Court, that is exactly what occurred and we were able to obtain through negotiations the result we had hoped for. Our client’s DUI charge was dismissed in exchange for a plea to reckless driving. Our client’s driver’s license was not suspended, she was not sentenced to jail time, and she does not have a DUI conviction on her criminal history.
